GENERAL CONDITIONS FOR CONTRACTING

Introduction

This contractual document will govern the General Terms and Conditions for contracting private transport services (hereinafter, "Terms and Conditions") through the website https://taxitransferspuertoalcudia.com, owned by Alcudia Mallorca Cab S.L., hereinafter, the PROVIDER, whose contact details are also listed in the Legal Notice of this website.

These Terms and Conditions will remain published on the website for the USER to reproduce and save as confirmation of the contract and may be modified at any time by the PROVIDER. It is the responsibility of the USER to periodically read them, as the terms applicable will be those in force at the time the orders are placed.

The contracts will not be subject to any formal requirement except for those expressly mentioned in the Civil and Commercial Codes and in this or other special laws.

Acceptance of this document implies that the USER:

Has read, understands, and comprehends the contents herein.

Is a person with sufficient capacity to contract.

Assumes all obligations stated herein.

These terms will be valid for an indefinite period and will apply to all contracts made through the PROVIDER's website.

The PROVIDER informs that the business is responsible and aware of the current legislation and reserves the right to unilaterally modify the conditions, without such modifications affecting the terms and conditions that were in effect before the modification.

Identity of the Contracting Parties

On one hand, the PROVIDER of the services contracted by the USER is Alcudia Mallorca Cab S.L., with its registered office at C/ Bisbe Pont 7, Bajo A - Alcudia - 07400 (Illes Balears), Tax ID number (CIF) B57830598, and customer/USER service phone number: 616009370.

On the other hand, the USER, responsible for the accuracy of the personal data provided to the PROVIDER.

Purpose of the Contract

The purpose of this contract is to regulate the contractual sales relationship that arises between the PROVIDER and the USER when the latter accepts the corresponding checkbox during the online contracting process.

The contractual sales relationship entails the delivery, in exchange for a specified price publicly displayed on the website, of a specific service.

The images of the vehicles shown on our website correspond to some of the vehicles in our fleet. However, we do not guarantee that the vehicle assigned for your transfer will be exactly the same as the one shown in the photos. Since we also collaborate with partners who have their own vehicles, on some occasions, your transfer may be carried out by one of our partner's vehicles. In any case, all vehicles meet the safety and comfort standards that ensure a pleasant travel experience.

The website does not accept reservations with less than 48 hours' notice, but if you need to make a booking with shorter notice, you may contact the PROVIDER directly by phone or email. If there is availability, we will proceed with the reservation manually and send you the confirmation, applying the same conditions stipulated here.

Data Rectification

When the USER identifies errors in the data published on the website or in the documents generated by the contractual relationship, they can notify us at the email taxi40.se@gmail.com so that Alcudia Mallorca Cab S.L. can correct them as soon as possible.

The USER may keep their data updated by accessing their user account.

Contracting Procedure

To access the services offered by the PROVIDER, the USER must be of legal age. Therefore, the USER must freely and voluntarily provide the personal data requested, which will be treated in accordance with the provisions of Regulation (EU) 2016/679 of April 27, 2016 (GDPR), concerning the protection of natural persons with regard to the processing of personal data and the free movement of such data, and Organic Law 3/2018 of December 5 (LOPDGDD), regarding the protection of personal data, as detailed in the Legal Notice and Privacy Policy of this website.

It is hereby informed that, in compliance with Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE), the contracting procedure will follow these steps:

1. GENERAL CONTRACTING CLAUSES

Unless otherwise specifically agreed in writing, placing an order with the PROVIDER will imply the USER's acceptance of these legal conditions. No stipulation made by the USER may differ from those of the PROVIDER unless it has been expressly accepted in advance and in writing by the PROVIDER.

2. SERVICE CONDITIONS

Failure to execute the distance contract

If it is not possible to execute the contract because the contracted service is not available within the expected time, the USER will be informed of the unavailability and will be entitled to cancel the booking and receive a full refund at no additional cost, without any liability for damages attributable to the PROVIDER.

In the case of an unjustified delay by the PROVIDER in refunding the full amount, the USER may claim double the amount owed, without prejudice to their right to be compensated for any damages that exceed this amount.

3. CHANGES AND CANCELLATIONS

The right of withdrawal shall not apply to contracts referred to and listed in Article 103 of Royal Legislative Decree 1/2007, and which are detailed here.

Any changes or cancellations to the booking must be made at least 48 hours in advance at no additional cost. To manage changes or cancellations, you must contact us through the previously mentioned contact methods. You must provide the booking number to proceed with the change or cancellation. Changes will be validated by sending a new booking, which must be reviewed by the USER. These changes are only effective once the new booking has been sent. If you do not receive it, you must contact the PROVIDER.

4. CLAIMS AND ONLINE DISPUTE RESOLUTION

Any claim that the USER deems appropriate will be addressed as soon as possible and may be submitted through the following contact addresses:

Online Dispute Resolution (ODR)

In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free-access platform for online dispute resolution between the USER and the PROVIDER, without the need to resort to the courts, through the intervention of a third party, known as a Dispute Resolution Body, which acts as an intermediary between both parties. This body is neutral and will engage in dialogue with both parties to reach an agreement, potentially suggesting and/or imposing a solution to the dispute.

5. FORCE MAJEURE

The parties shall not be held liable for any failure due to force majeure. The obligation will be delayed until the force majeure event ceases.

The PROVIDER does not guarantee the itinerary or exact arrival time due to external factors such as traffic congestion or accidents. Our services are covered by a civil liability insurance policy.

6. JURISDICTION

The USER may not assign, transfer, or transmit the contracted rights, responsibilities, and obligations in the sale.

If any provision of these conditions is considered null or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or modified in any way.

The USER declares to have read, understood, and fully accepted these Conditions.

7. GENERAL TERMS OF THE OFFER

All sales made by the PROVIDER will be subject to these Conditions.

No modification, alteration, or contrary agreement to the Commercial Proposal of Alcudia Mallorca Cab S.L. or to what is stipulated here will be effective unless expressly agreed in writing and signed by the PROVIDER. In this case, these particular agreements will prevail.

Given the ongoing technical advances and service improvements, the PROVIDER reserves the right to modify its specifications regarding the information provided in its advertising, as long as it does not affect the value of the services offered. These modifications will also be valid if, for any reason, the ability to supply the services offered is affected.

WAITING TIME

For airport pick-ups, the driver will wait up to 60 minutes for free from the time of flight landing. If the customer takes more than 60 minutes to exit the arrivals area, an additional charge may apply. If the driver cannot contact the customer or the customer does not contact the driver, the service will be canceled after the first hour with no right to a refund.

For pick-ups at accommodations, the waiting time is 10 minutes. It is the USER's responsibility to contact the driver if they cannot locate them or if there is a delay and/or they have missed the flight. The USER must remain attentive to the phone number provided to receive any notification from the driver. Additionally, the USER must wait for the driver and not use an alternative service without prior authorization from the company. If the customer does not verify the booking details upon receiving the confirmation, and this causes problems, the company will not be held responsible.

PASSENGERS

When making a booking, you must consider the number of passengers, including children. Children must occupy their own seat and, if necessary, use an appropriate child safety seat.

In this regard, all children under the age of 12 or under 135 cm in height must occupy a seat in the vehicle using an approved child seat. The responsibility for adding the child seat to the booking lies with the USER making the reservation, as well as for installing it correctly and ensuring that it is compatible with the vehicle. If the USER prefers to bring their own child seat, it does not need to be included in the booking. If the PROVIDER does not have a child seat available in the vehicle, the amount corresponding to it will be refunded, and children over the age of 3 must use a seatbelt.

LUGGAGE

The service includes two (2) pieces of luggage per person (1 suitcase and 1 hand luggage). A folding stroller or a folding wheelchair of no larger size than hand luggage is also allowed. All luggage must be declared at the time of booking. Bicycles transported in a box can be added during the booking process. For assembled bicycles or special luggage, the customer must contact us directly to make the booking manually. If the luggage is not added to the booking and a larger vehicle or two vehicles are required, the additional cost will be borne by the USER.

The transportation of luggage and personal belongings is the responsibility of the customer. In case of damage or loss, we are not responsible. For this, the customer should take out insurance on their own.

PETS

Pets are transported upon request and authorization, in a pet carrier. Guide dogs are always accepted, but prior notice is required to provide an appropriate vehicle.

PEOPLE WITH REDUCED MOBILITY

If you are traveling with a person with reduced mobility who can get out of their wheelchair, and the wheelchair is foldable and not larger than a large suitcase, you can make a reservation through this website by indicating this need in the remarks. If more than one wheelchair is being carried, you must contact the PROVIDER directly.

If the person cannot leave the wheelchair and requires an adapted vehicle, you must contact us directly so we can offer available options and, if necessary, make a manual reservation (subject to availability).

PASSENGER CONDUCT

Consumption of alcohol, drugs, eating, or smoking inside or around the vehicle is prohibited. We reserve the right of admission if a person is under the influence of alcohol or drugs or if they pose a danger to the driver or others. If damage is caused to the vehicle, we reserve the right to charge for the damage or cleaning.

LOST PROPERTY

The PROVIDER is not responsible for lost property in the vehicle or its surroundings. The USER can contact the PROVIDER to report the loss of an item. If the item is found, delivery service fees may apply, depending on availability. If the item is not found, we are not responsible.

EXTRA SERVICES

Extra stops must be reserved in advance and will have an additional cost. If they are not pre-booked, we cannot guarantee they can be made.

8. PRICE AND VALIDITY PERIOD OF THE OFFER

The prices indicated for each service include Value Added Tax (VAT) or other applicable taxes. These prices, unless expressly stated otherwise, do not include shipping or communication costs, handling, wrapping, shipping insurance, or any other additional services related to the acquired service.

The prices applicable to each service are those published on the website and will be expressed in EURO. The USER acknowledges that the economic valuation of some services may vary in real time.

Before making the purchase, the USER can review all the details of the estimate online: services, quantities, price, availability, charges, discounts, taxes, and the total purchase. Prices may change daily until the order is placed.

Once the order is placed, prices will be maintained regardless of service availability.

Any payment made to the PROVIDER will result in the issuance of an invoice in the name of the USER who completed the booking. If the USER wishes to receive the invoice via email, they must request it through any of the means provided by the PROVIDER, and they are informed that this decision can be revoked at any time.

9. TRANSPORT COSTS

There are no transport costs.

10.PAYMENT METHODS, CHARGES, AND DISCOUNTS

The PROVIDER is responsible for the financial transactions and offers the following methods to make a payment for an order:

Credit and debit card (only through this website).

Additionally, the USER has the option to pay in cash at the end of the service. In this case, the USER must pay the price for each trip separately and not in advance. This means that the USER cannot pay the driver in charge of the outbound trip for both the outbound and return trips.

Security measures

The website uses generally accepted information security techniques such as SSL, data entered on a secure page, firewalls, access control procedures, and cryptographic mechanisms to avoid unauthorized access to data. To achieve these purposes, the USER agrees that the PROVIDER obtains data for the corresponding authentication of access controls.

The PROVIDER commits not to allow any transaction that is or is considered illegal by credit card brands or the acquiring bank, which may or has the potential to harm their goodwill or negatively influence them.

The following activities are prohibited under the credit card brand programs: the sale or offer of a product or service that does not comply with all applicable laws to the Buyer, Issuing Bank, Merchant, or Cardholder.

11. PURCHASE PROCESS

Basket (quote simulation)

Any service from our catalog can be added to the basket. The basket will only show the selected services, quantity, price, and total amount. Once the basket is saved, taxes, charges, and discounts will be calculated based on the data entered.

The baskets have no administrative binding; it is merely a section where a budget can be simulated without any commitment from either party.

From the basket, an order can be placed by following the next steps for its proper formalization:

Verification of billing details.

Verification of the service delivery method (download, activation...).

Selection of the payment method.

Complete the booking (purchase).

Once the booking is processed, the system instantly sends an email to the PROVIDER’s management department and another to the USER’s email confirming the booking.

12. SEVERABILITY AND SUSPENSION OR TERMINATION OF THE CONTRACT

If any of these terms and conditions are considered illegal, null, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any of the remaining conditions.

Without prior notice, the PROVIDER may suspend or terminate the USER’s access to its services, in whole or in part, for any valid reason, including, without limitation, when the USER fails to comply with any of the obligations set out in this document or any applicable law, license, regulation, directive, code of conduct, or usage policies.

When exercising any of its rights or powers under this Clause, such exercise will not prejudice or affect the exercise of any other right, power, or remedy available to Alcudia Mallorca Cab S.L.

13. WARRANTIES AND RETURNS

Warranties will comply with the regulations in the Title referring to "Warranties and After-Sales Services" of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, which you can access by clicking here.

14. APPLICABLE LAW AND JURISDICTION

These conditions will be governed by or interpreted in accordance with Spanish law where not expressly established. Any disputes that may arise from the provision of the products or services covered by these Conditions will be submitted to the courts of the USER’s domicile, the place of performance of the obligation, or where the property is located if it is immovable.
